1. The Agreement
These Terms of Service ("Terms") govern your use of the Balansert app ("the App"), operated by Doktor Five AS (org.nr [org.nr]) ("Balansert", "we", "us"). Doktor Five AS is the data controller for the processing of personal data as described in our Privacy Policy.
By downloading, installing or using the App, you confirm that you have read, understood and agree to these Terms.
If you do not accept these Terms, please do not use the App.
2. Important Medical Disclaimer
IMPORTANT: Please read this carefully.
The content of the Balansert app, including meditation exercises, courses, guided sessions and other material ("Content"), is intended solely as general support for wellbeing and self-care. The Content is not:
- Medical treatment or therapy
- A substitute for professional psychological, psychiatric or medical help
- A means of diagnosing, treating or curing any disease or condition
- Crisis intervention or emergency support
If you are experiencing serious mental health difficulties, anxiety disorders, depression, suicidal thoughts or other severe symptoms, we strongly encourage you to seek qualified professional help. In an acute crisis, please contact your local emergency services or a national crisis helpline in your country. An international directory of crisis helplines is available at findahelpline.com.
Use of the App is at your own risk.
Balansert accepts no liability for consequences arising from the App being used as a substitute for professional healthcare.
3. Licence and Permitted Use
Balansert grants you a limited, non-exclusive, non-transferable and revocable licence to use the App for personal, non-commercial purposes, provided you comply with these Terms.
You may not:
- Copy, modify, distribute or sell the App or any part of it
- Decompile or attempt to extract the source code
- Use the App for commercial purposes without Balansert's prior written consent
- Circumvent any technical protection mechanisms in the App
4. Subscription and Payment
Access to full content in the App requires an active subscription. Subscription terms, pricing and duration are set out in the App Store (Apple) or Google Play at the time of purchase.
The subscription renews automatically unless cancelled before the end of the current period. Cancellation is managed through your App Store or Google Play account settings.
Balansert does not provide refunds of subscription fees unless otherwise required by applicable law. This does not affect any statutory rights you may have under applicable law.
5. User Responsibilities
You are responsible for:
- Providing accurate and up-to-date information
- Keeping your login credentials confidential
- Using the App in compliance with applicable law and these Terms
- Not misusing the App in any way that could harm Balansert or other users
6. Intellectual Property
All content in the App, including text, audio, graphics, design and code, belongs to Balansert or its licensors and is protected by copyright and other intellectual property rights. Nothing in these Terms shall be construed as a transfer of intellectual property rights to the user.
7. Limitation of Liability
To the extent permitted by applicable law, the App is provided "as is" without warranties of any kind.
Balansert is not liable for:
- Indirect loss, consequential damages, lost revenue or loss of data arising from use of the App
- Interruption of access to the App due to technical failures, maintenance or circumstances beyond our control
- Consequences of the App being used in breach of these Terms or the medical disclaimer in section 2
In any event, Balansert's total liability to you shall not exceed the amount you have paid for your subscription in the preceding 12 months.
8. Changes to the App and Terms
Balansert may change, update or discontinue the App or any part of it. Where reasonably possible, such changes will be made with prior notice.
We may also update these Terms from time to time. Material changes will be communicated by email or via a notification in the App. Continued use of the App after updated Terms have been published constitutes acceptance of the new Terms.
9. Termination
Balansert may suspend or terminate your access to the App if you breach these Terms.
You may stop using the App at any time by cancelling your subscription and uninstalling the App.
10. Age Requirement
The App is intended for users aged 16 years or older. By using the App, you confirm that you meet this requirement.
11. Privacy
Your personal data is processed in accordance with our Privacy Policy, available in the App. We recommend that you read this carefully.
12. Governing Law and Jurisdiction
These Terms are governed by Norwegian law. Any disputes that cannot be resolved amicably shall be brought before Oslo District Court as the court of first instance.
